NOTICE OF SALE

NOTICE is hereby given that on the 9th day of May, 2012, at the hour of 10:00 a.m. the undersigned Special Master, or his designee, will, at 1660 Hickory Loop, Las Cruces, New Mexico 88005, sell, assign and convey, FOR CASH, all of the right, title and interest of Defendants Angie L. McLaughlin and Mark L. Lancaster, and to the hereinafter described land and appurtenances to the highest bidder for cash. The property to be sold is located in Dona Ana County, New Mexico, and is more particularly described as follows:SURFACE TITLE ONLY: A tract of land situate in Fort Selden, Dona Ana County, New Mexico being a part of Lot 36A, Fort Selden North Acreage Tracts Replat No. 3, filed February 19, 1992, in Book 17, page 137, Dona Ana County records and being more particularly described as follows, to wit:

Beginning at a ?" iron rod set for the Southwest corner of the tract herein described; whence the Northwest corner of Lost 36B. Fort Selden North Acreage tracts replat No. 3, bears N. 84?10'00" W., 329.24 feet;

Thence from the point of beginning, N. 05?11'06" E., 228.67 feet to a ?" iron rod set on the North line of a 25 foot wide road and utility easement (a/k/ Hurt Road) for the Northwest corner of this tract; Thence along the north line of said easement, S. 86?39'24" E., 193.08 feet to a ?" iron rod set on the west line of Desert Edge for the Northeast corner of this tract; Thence along the west line of Desert Edge the following two courses and distances: around the arc of a curve to the right, having a radius of 1101.90 feet, through a central angle of 02?39'40" with an arc length of 51.18 feet, and whose long chord bears S. 04?40'27" W., 51.17 feet to a ?" iron rod found;

Thence around the arc of a curve to the right, having a radius of 1107.67 feet, through a central angle of 9?39'48", with an arc length of 186.82 feet, and whose long chords bears S. 10?49'46" W., 186.59 feet to a ?" iron rod set for the Southeast corner of this tract;

Thence N. 84?10'00" W. 175.09 feet to the point of beginning, containing 1.006 acres of land, more or less.

(a/k/a 12405 Desert Edge, Radium Springs, NM 88054).including all improvements, fixtures and attachment. Subject to all taxes, utility liens and other restrictions and easements of record, and subject to the statutory one (1) months right of redemption by the Defendants from entry of an order approving the sale. The foregoing sale will be made to satisfy allowed claims by Pioneer Bank against the Defendants, in rem, in the principal amount of $254,447.61, all accrued interest, costs, fees, charges and attorney's fees as Ordered, pursuant to Order of the District Court of Dona Ana County, New Mexico in the above numbered and entitled cause entered on March 28, 2012, together with interest after Judgment at the rate of 8.750%, costs of sale, and additional costs which may be incurred by Plaintiff. Pioneer Bank has the right to bid at such sale all of their joint claims, covered by the above-referenced Judgment and submit its/their bid verbally or in writing. Pioneer Bank may apply all or part of the sums due to them to the purchase price in lieu of cash. The sale may be postponed and rescheduled at the discretion of the Special Master. The Courts decree, having duly appointed the Special Master to advertise and immediately offer for sale the subject real estate and to apply the proceeds of sale first to the cost of sale and then to the Special Masters fees, then to pay the above-described claims recognized in favor of Pioneer Bank and cost of sale, and to pay into the registry of Court any balance remaining to satisfy future adjudication of other claims against the estate. NOW, therefore, Notice is hereby given that in the event that said property is not sooner redeemed, the undersigned will as set forth above, offer for sale and sell to the highest bidder for cash or equivalent the land and improvements described above for the purpose of satisfying the allowed claims of Pioneer Bank, the judgment decreed herein and the Order together with any cost, cost of advertisement and publication, and a reasonable Special Master's fee which has been fixed by the Court in the amount of $250.00 (gross receipts tax included). Sale is subject to entry of an order of the Court approving the sale.
